Sister Fox to appeal deportation anew as Immigration affirms order

AUSTRALIAN nun Patricia Anne Fox on Thursday will appeal anew a deportation order against her by the Bureau of Immigration, a day after the Department of Justice (DOJ) confirmed that her motion for reconsideration was denied.

In a text message to The Manila Times, one of Fox’s legal counsels, Maria Sol Taule, said, “We will file an appeal before the Department of Justice next week”.

The DOJ has jurisdiction over Immigration, which denied her motion for reconsideration to reverse its July 19 resolution to deport her for allegedly engaging in political activism because “no new matters were raised”.

Taule said Fox received the August 23 decision on Wednesday.

Nadja de Vera, spokesperson of Fox, said that “we are reviewing the appeal and hopefully by Monday, we can appeal before the DoJ.”

Immigration said that “Fox was given 30 days upon receipt of the order “before it can be considered final and executory”.

On June 18, Fox won a temporary reprieve after the DOJ nullified the BI ruling to forfeit her visa and subsequent order for her to leave by the end of May for “lack of legal basis”.

On April 16, Fox was detained overnight at the BI facility for supposedly attending protest rallies, fact-finding missions”, which according to the BI violated her missionary visa terms.

Fox made the headlines after President Rodrigo Duterte accused her of displaying “disorderly conduct” and having a “foul mouth.”
