Customs Commissioner Guerrero, 4 others accused of graft before Ombudsman

CUSTOMS Commissioner Leonardo Rey Guerrero was accused of graft before the Office of the Ombudsman in connection with the alleged illegal designation of four persons.
The four, who were named respondents along with Guerrero, are: Donato San Juan, Teodoro Jumamil, George Avila, and Raniel Ramiro.
The four complaints were filed by Joana Marie Gonzales before the Ombudsman on Thursday.
Guerrero was named in all four complaints; Ramiro in two; San Juan, Jumamil and Avila, one each.
According to the complainant, San Juan, Jumamil, Avila, and Ramiro were designated acting deputy commissioner of the Internal Administration Group, acting deputy commissioner of the Revenue Collection Monitoring Group, chief of the Risk Managememt Office, and acting deputy commissioner of the Intelligence Group, respectively.
Section 132 of Rule 12 of the 2017 Omnibus Rules on Appointments and Other Human Resource Actions prohibited the designation of a “consultant, contractual, non-career or detailed employee” to a position exercising control or supervision over regular and career employees, based on the complaints.
The complainant argued that San Juan, Jumamil, and Ramiro should be held liable for alleged usurpation of official functions and that Guerrero should be charged as alleged co-conspirator.
In the complaint wherein Guerrero, Ramiro, and Avila were named respondents, Gonzales argued that Avila should be held liable for alleged usurpation of official functions and that Guerrero and Ramiro should be charged as alleged co-conspirators.
The complainant added that the respondents should be held administratively liable for allegedly “committing acts of grave misconduct and/or gross neglect of duty and conduct prejudicial to the best interest of the service” for supposedly “absolutely disobeying and disregarding civil service rules.” REINA C.
