The Department of Justice (DoJ) has filed murder and frustrated murder charges against businessman Alan Dennis Sytin along with his two co-accused in connection with the 2018 killing of his elder brother Dominic.

“The information against the three accused has been filed in Olongapo City,” said DoJ spokesman Undersecretary Markk Perete.

Aside from Dennis, those also charged with him were self-confessed gunman Edgardo Luib and Ryan Rementilla who was fired by Dominic from United Auctioneers Inc. (UAI) due to alleged anomalies.

The charges were filed after a DoJ panel of prosecutors conducted a preliminary investigation on the complaint filed by Dominic’s wife Anna Marietta.

“The National Prosecution Service has confirmed that it found probable cause to charge Alan Dennis Lim Sytin for the killing of his brother, businessman Dominic Sytin,” Perete said.

Meanwhile, Justice Secretary Menardo Guevarra has asked the Supreme Court (SC) to transfer the case from Olongapo City to Metro Manila.

Guevarra explained he made the move “for the safety and security of the witnesses principally, and to avoid any pressure upon the court and the prosecution, given the sphere of influence of the contending parties and the intense public interest generated by this sensational case.”

In the meantime, Guevarra said “the Olongapo court should proceed until the Supreme Court actually orders a transfer of venue.”

The case concerns the shooting incident which took place on Nov. 28, 2018 in front of the Light House Hotel inside the Subic Bay Freeport Zone, which resulted in the killing of Dominic and wounding of his bodyguard Efren Espartero Jr.

In a resolution which declared that probable cause was found in indicting the three accused, state prosecutors relied on the testimony of Luib who is also the childhood friend of Rementilla.

“Based on the statements made by respondent Luib, we have no recourse but to find probable cause that respondents Alan Dennis L. Sytin and Ryan Rementilla a.k.a. Oliver Fuentes conspired with each other and carried out their plan to kill victim Sytin and hired respondent Luib to execute the plan,” read the resolution approved by Prosecutor General Benedicto Malcontento and Senior Deputy State Prosecutor Richard Anthony Fadullon.
