Anti-‘endo’ bill up for Duterte’s signature after House adopts Senate version

THE ban against contractualization will soon become law once President Rodrigo Duterte affixes his signature to the Senate bill, which the House of Representatives formally adopted on Tuesday.
The House adoption of Senate Bill (SB) 1826 or the proposed Security of Tenure Act, which the senators approved on third and final reading, eliminated the need to convene for a bicameral conference committee.
SB 1826, which was considered a priority measure by Duterte, proposes that labor-only contracting exists when any of the following instances occur: The job contractor merely supplies, recruits, and places workers on a contract; the workers supplied to a contractee perform tasks/activities that are listed by the industry to be directly related to the core business of the contractee; and the contractee has direct control and supervision of the workers supplied by the contractor.
The measure also classifies workers into regular, probationary, project and seasonal, requiring contractors to obtain a license from the Department of Labor and Employment (DoLE) to engage in job contracting.
Popularly known as “endo,” it is a labor scheme, which companies apply in hiring workers for five months, terminating them on the sixth and withholding benefits given to regular employees. GLEE JALEA
