Comelec cancels CamSur bet’s CoC

THE Commission on Elections (Comelec) First Division canceled on March 29 the Certificate of Candidacy (CoC) of Edgardo Tallado, who is running for governor in Camarines Norte.

Norberto Villamin and Senandro Jalgalado, filed last year a petition asking the Comelec to deny due course to and/or cancel Tallado’s CoC on the ground that the midterm elections in May would be his fourth term.

Part of Comelec ruling said, “the pendency of Tallado’s petition for review before the Court of Appeals on the suspension order the Ombudsman meted to him, meant he did not vacate and Tallado was not succeeded by his vice governor at that time. If it was truly vacant, such permanent vacancy should have triggered the operation of Section 44 of LGC (Local Government Code), which governs succession in cases involving permanent vacancies in elective offices.”

The decision further said, “No succession ever took place. There was no break in the respondent’s term. Clearly, the respondent’s suspension is not to be considered an involuntary interruption of respondent’s continuity of service. Whereby, premises considered, the petition is hereby granted.”

The Ombudsman suspended Tallado in 2015 and dismissed him from office in March 2018. He was also meted the penalty of perpetual disqualification. Both decisions stemmed from a complaint of former provincial veterinarian Edgardo Gonzales for grave abuse of authority and grave misconduct after Tallado dismissed him as provincial veterinarian and assigned him to the post of public information officer, a position Tallado created for Gonzales but with no function and staff.

In a telephone interview, Tallado told The Manila Times that he had filed a motion for reconsideration on the latest ruling before the Comelec en Banc on Tuesday.
