PETALING JAYA — A 24-year-old college student who was found guilty of robbing her Tinder date by using a knife, was sentenced by a Sessions Court here to six years in jail.
Sessions Court judge Mohammed Mokhzani Mokhtar passed the sentence against Mizan Qistina Razali on Thursday (Jan 31), after ruling that the prosecution had proven its case beyond reasonable doubt.
The court ordered for the jail time to run from the date of sentencing.
According to the charge sheet, Mizan Qistina, together with a man still at large, had gang robbed Foong Wei Chieh, 34, using a knife.
Foong’s handphone and RM1,500 cash were taken.
The offense was committed at Cova Suites, Jalan Teknologi, Kota Damansara, near here at 9:30 pm on Nov 24, 2016.
The charge under Section 397 of the Penal Code carries a maximum 20 years imprisonment and whipping.
Earlier, lawyer Norhasham Hasan, who represented the accused, asked the court to mete out a lenient sentence, on grounds that his client was a young offender and it was her first offence.
“My client was influenced by her ex-boyfriend. She needs to support her family, as her father is no longer working,” Norhasham said.
DPP Asyhraf Ashy’ari Kamaruzaman, however, asked for a heavy sentence as the accused had premeditated the crime and used a dangerous weapon.
The court then passed the sentence.
It also allowed Norhasham’s application for a stay of execution pending an appeal, while maintaining the bail at RM7,000.
According to the statements of fact, Mizan Qistina invited the victim to her condominium for sex, after getting to know him on the dating site Tinder.
The victim then went up to her unit and found her already naked.
However, another man entered the house and an altercation ensued. The victim was then robbed.
The accused went down to the victim’s car and took his wallet.
She also went to the ATM and withdrew the victim’s money.
