Ombudsman orders withdrawal of motions to suspend incumbent officials facing raps
Ombudsman Samuel Martires ordered the withdrawal of motions seeking the preventive suspension of incumbent officials facing charges.
Martires’ order, which directs the withdrawal of “[a]ll motions for suspension pendente lite [pending litigation]which have been filed before the issuance of this Memorandum but which remain unresolved by the trial courts,” prompted prosecutors handling the graft cases against Sen. Gregorio “Gringo” Honasan 2nd to file an urgent manifestation with ex-parte motion asking the Ombudsman to reconsider his order in relation to the senator.
“What the panel [of prosecutors]respectfully seeks, by filing this instant Manifestation with Motion, is to fully concede with and respect the full authority and sound wisdom of this Honorable Court to order the preventive suspension motu proprio [on its own initiative]of herein accused pending litigation,” they said.
They said that the memorandum was directed towards all prosecutors of the Ombudsman’s Office of the Special Prosecutor.
Honasan and other individuals are facing graft before the Sandiganbayan’s Second Division in connection with the alleged misuse of his Priority Development Assistance Fund (PDAF) or pork barrel allocation totaling P29.1 million in 2012.
Earlier, the prosecution filed a motion seeking the senator’s preventive suspension pending litigation of the cases. REINA TOLENTINO
